General Admission:

Admission on the sailing boat is subject to acceptance of the following terms and conditions.
By booking a charter and boarding the boat, passengers agree to be bound by these terms and conditions.

  1. CHARTER FEE AND THE INITIAL DEPOSIT

    1.Malta Sailing Experiences holds the right to change its prices when desired before the charterer has confirmed its booking. The amount shown for the charter shall be paid as            follows-

    (a)Twenty percent (20%) - On conformation of the booking to secure the reservation.

    (b)Eighty Percent (80%) –

              (i)48 hours prior to the commencement of the charter period if using bank      transfer, or

              (ii)directly to the skipper on board on the day of the charter.

     

    2. Maximum number of persons for day charter, depends on the boat size and will be stipulated according to Transport Malta license. The maximum number of persons, will be communicated to the charterer at the time of booking,

    If the number of people aboard our boats is exceeded at any point during the duration of the charter, this will result in a violation of terms and conditions of agreement. Therefore, Malta Sailing Experiences will be permitted to terminate the terms and conditions of agreement by right and will be authorized to notify the charterer to disembark and return the boat to the relevant point of transfer. Breaching the terms will result in no reimbursement of the fee paid in advance. Damages caused through failure to comply with this clause, shall be paid by the client.

     

    CRUISING AND AGREED AREAS

    It is the skipper’s responsibility to obey and operate the boat in areas and laws within the regions discussed by Malta Sailing Experiences and the MALTESE MARITIME LAW. Failure to comply in the agreed areas where Malta Sailing Experiences is not licenced or insured will be a breach of terms and conditions of agreement.

     

    OPERATION OF THE VESSEL

    ​​1.The chartered boat may only be sailed by those persons who are qualified to do so. During the charter, the boat shall be used only by the licensed skipper and according to the instructions and regulations of the shipping authorities, customs, Police and port authorities of Malta. 

    2.For multi-day charters, the charterer will pay all operating costs, such as petrol and lubricating oils, and also bear the costs for any port the charterer would like to stay in, other than the yacht’s moored port.

    3.Any fines imposed for infringing such depositions, shall be paid by the client.

     

    REPLACEMENT POLICY

    1.Where a boat offered by Malta Sailing Experiences cannot be provided to the client in unforeseen events, previous charter breakdowns or any reason beyond the control of Malta Sailing Experiences, the latter will offer the client the opportunity to rent another boat with a similar layout design or similar dimensions, with equal or similar performance levels as agreed previously, or reschedule to another date. 

    2.If the client declines offers made by Malta Sailing Experiences replacement policy, they are entitled to a one hundred percent (100%) reimbursement for any amounts paid. The charterer is also not eligible to receive an indemnification package.

     

     

    BREAKDOWN AND DISABLEMENT

    1.If the boat chartered from Malta Sailing Experiences becomes disabled due to a mechanical failure, we will offer the charterer the opportunity to rent another boat with a similar layout design or similar dimensions with equal or similar performance levels as agreed previously. The client is also entitled to a one hundred percent (100%) reimbursement for any event of this nature.

    2.The charterer is not eligible to receive an indemnification package.

     

    RULES AND REGULATIONS OF THE USE OF VESSELS

    1.Malta Sailing Experiences is intended exclusively for entertainment charters and not for commercial use or third-party use. Under no circumstances whatsoever, therefore, can the boat be used for commercial operations, professional fishing, transport, regattas, sports competitions, and any other non-competitive activities for which the boat is not intended.

    2. The charterer and their party must act accordingly in a well-behaved manner and must not disturb any third parties in the duration of the time period.  

    3. Zero-Tolerance Drug Policy: No drug use of any kind will be tolerated on the boat. If a skipper suspects or is made aware of any drug-use, they will turn the boat around and return to port. No refund will be given.

    4. Alcohol Consumption and Conduct: Passengers are permitted to consume alcohol responsibly on the boat. However, if a passenger has consumed too much alcohol and becomes unruly, disruptive, or abusive, the skipper reserves the right to terminate the charter and return to port. No refund will be issued in these circumstances.

    5. Liability for Injuries: We assume no responsibility or liability for any injuries or damages arising from reckless behaviour or carelessness, or drug- or alcohol-induced actions. By boarding the boat, passengers agree to behave in a safe and responsible manner. Safety tips will be given by the skipper in their briefing. Passengers accept all responsibility for any injuries or damages they cause to themselves or others.

    6.Skipper's Role: The primary role of the skipper is to navigate the sailing boat and ensure the safety of all passengers on board. The skipper is not responsible for cleaning up after passengers. Passengers are expected to respect the boat and maintain its cleanliness throughout the duration of the trip.

    7.Cleaning Fee: A cleaning fee of €50 will be charged if the boat is returned in a condition that is deemed excessively dirty or untidy by the skipper or owner. This charge is meant to cover the cost of the additional cleaning required and does not exempt passengers from their responsibility to maintain the cleanliness of the boat during the trip.This fee will be due immediately upon the return of the boat.

    8. Use of Cabins: The cabins (sleeping quarters) are reserved for multi-day charters ONLY. For day charters, the cabins are out-of-bounds, except for changing of clothes. Any other uses, are strictly prohibited unless expressly permitted by us in writing. Any damage caused to the cabins due to misuse will be the responsibility of the passengers involved, and charges will be applied accordingly.

    9. Equipment Use: Any equipment such as paddleboards, is used at the passengers' own risk. We are not liable for any injuries or damages resulting from the use of this equipment.

    10. Indemnity: Passengers agree to indemnify and hold harmless the boat owner, skipper, and all associated parties from any and all claims, actions, damages, liabilities, and expenses that may arise from their actions or omissions, including but not limited to those related to the use of drugs or alcohol, reckless behavior, and the cleanliness of the boat.

    11. Damages: The Client will be held responsible for any damages to the boat caused by the Client or their guests due to negligent or reckless behavior, and will be charged accordingly.

    12. Noise Control and Respect for Others: Playing music is permitted on the trip; however, excessively loud music or other noise that disturbs the occupants of other boats, disrupts the natural environment, or disrupts the skipper while doing his job is prohibited. Failure to comply with this rule may lead to immediate termination of the sailing trip without refund.

    13. Firearms and other dangerous weapons: Malta Sailing Experiences strictly prohibits the possession and use of illegal weapons including firearms and other dangerous weapons. Should any such weapon be on board, the charter will be terminated immediately and no refund will be given.

    14. Goods and accessories: The charterer must ensure that goods and accessories belonging to the boat must be brought back to the point of transfer. If goods and accessories inspected afterwards are deemed to be damaged, the charterer must pay an additional fee. Malta Sailing Experiences inspects all boats after their return.

    15. The charterer and their party are strictly prohibited in any dangerous areas of the boat. A violation of this regulation will be a breach of the terms and conditions of agreement.

    16. Malta Sailing Experiences prohibits third parties who do not belong to the original party on the vessel unless notified before the point of departure.

    17. Smoking: Malta Sailing Experiences prohibits smoking apart from an exterior designated area. The charterer and its party are only allowed to smoke in this exterior designated area. Failure to comply with this regulation results in a €100 penalty and damages are at cost of the charterer.

    18.If the boat is confiscated by the local authorities due to the fault of the client through misconduct, Malta Sailing Experiences shall charge a fixed daily fee of seven hundred and fifty Euros (€750) until the boat is returned, and any damages caused will be paid for by the client.

     

    INSURANCE

    1.Malta Sailing Experiences recommends that the client takes out travel insurance with their company provider of choice to protect its party from unseen events or cancellation. 

     

    END CLEAN

    1.An extra fee of fifty Euros (€50) will be charged for the cleaning of the boat at the end of the charter period if the boat is left in an improper state caused by the charterer.

     

    REIMBURSEMENT POLICY

    1.If not stated in advance or agreed upon, Malta Sailing Experiences’ reimbursement policy is that for any liabilities incurred by the charterer, Malta Sailing Experiences reserves the right to keep part or all of the deposit to cover the liabilities incurred.

    2. Where the charterer is guaranteed a full reimbursement, the payment will be made the same way that it is received by Malta Sailing Experiences.

     

    FUEL RULES

    1.Fuel is included in the daily charter fee. The skipper will be approved by Malta Sailing Experiences and is the only person permitted to drive the boat for the skippered charter.

    2. If the charter is a multi-day charter, the fuel cost is to be paid by the client unless agreed otherwise.  Malta Sailing Experiences will make sure the tank is full at the start of the charter and will charge for the fuel that is used. 

     

    EXTRA COSTS

    1.Extra cost in addition to the charter fee, such as harbour fees outside home port, diver’s fees, customs formalities, national/local taxes as applicable and food & beverage services for the charters time of period, are at the cost of the client.

    2. Missing or damaged snorkelling equipment EUR 20.00 (incl.vat only) per missing piece

    DAY CHARTERS- The majority of the boats go out from 9am to 5.30pm – These can be tailored to the day.

    IF CHILDREN ARE ON BOARD, THE CHARTERER SHALL BE FULLY RESPONSIBLE FOR THEIR SAFETY AND CONDUCT. WE STRONGLY ADVISE THAT CHILDREN WEAR LIFEJACKETS AT ALL TIMES.

     

    By purchasing a boat charter or boarding the boat, you are acknowledging that you have read, understood, and agreed to these terms and conditions. Policies

COVID-19 Terms PUBLIC HEALTH PROTOCOLS

We follow all Maltese public health directives, including group sizes, temperature checking, sanitization, social distancing, and mask and/or visor wearing.

FLEXIBILITY

If you need to change your plans, there are free date changes and cancellations up to 21 days before your trip.

LOW DEPOSIT

Secure your boat trip with just a 20% deposit, and give yourself something to look forward to. You can pay the rest any time up to 2 weeks before your trip, or pay cash on the day.

Cancellation Policy

  1. Customers will receive a full refund or credit with 2 weeks notice of cancellation

  2. Customers will also receive a full refund or credit in the event of an operator's cancellation due to weather or other unforeseen circumstances. Our benchmark for cancellations is: winds above 20–25 knots and wave heights above 1.2 meters.

  3. We often warn clients a few days before their charter of inclement weather conditions, please see benchmark above. We only cancel charters due to inclement weather 24 hours in advance. In this case, you may choose to have your deposit refunded, your charter rescheduled, or opt for a credit note.

  4. Charters will not be cancelled if the weather forecast indicates isolated showers and/or possible showers.

  5. If the weather forecast indicates, constant rain and/or a high possibility of thunderstorms, we will cancel the charter and refund you in full.

  6. A charter can be cancelled mid-charter if the clients are using drugs, too drunk, unruly, or unsafe behaviour, or causing damage to the boat. The deposit will not be refunded, and payment will be expected for the whole charter.

  7. In the unlikely event that your boat is experiencing mechanical failure, we will endeavor to find a replacement boat, but if this is not possible, we will need to cancel your charter and refund you in full.

  8. Food orders cannot be refunded if cancelled within 4 days of your yacht charter date.

  9. No-shows will be charged the full price

Early Bird Discounts

  • A 10% discount will be given when chartering for more than 3 days on the boat Allegra.

    Discounts cannot be used together.


Additional Charges to your charter

  • The hourly rate, for any time spent onboard after the stipulated time is €50.

  • Overnight fee stay on board Allegra, of €150 (includes all bedding & towels).

  • Marina charges, (other than home marina berths) apply when chartered overnight.

Onboard Dining

  • A number of optional day and evening menus are available at a very reasonable price. Contact us for further details.

Payment Terms

  • A 20% deposit is required to confirm the charter booking.  The remainder of the balance should be paid 3 weeks before the charter date. If outstanding, the remaining balance must be paid in cash or by credit card on the day of the charter.

  • Your deposit will not be refunded if you cancel within 2 weeks of your charter date. 

  • All payments are to be made in cash, by bank transfer, PayPal, or by credit card. All bank charges must be incurred by the client.

  • Food orders cannot be refunded if cancelled within 4 days of your charter date. 

MEDICAL CONCERNS:

Please advise us of any conditions you may have that can affect your day’s excursion with us. It is important that you and we are prepared in the case of an emergency.
If you have any special requirements, please do not hesitate to let us know before your trip.

Preparing for your Yacht Charter | some tips

Don’t forget to bring with you:

  • Towels, sun cream, hats, and any other personal effects.

  • Goggles and fins. We have a few pairs of goggles onboard, but we do not stock fins.

  • Seasickness pills, should you think you need them.

  • Your food for the day, unless we are catering for you.
    Although we do have boat fridges, it is advisable to pack your food in food coolers.

  • Parking in Malta is an issue, so bear that in mind when planning your journey. You don’t want to waste any of your onboard time looking for parking.

  • Once you arrive at the marina, call your skipper so that they can open the gates to the pontoon.

  • Try the early bird charters - you get to the bays before all of the commercial tourist boats.

  • Try the late charters - You leave after everyone, so the bays are quiet, plus you get the added bonus of enjoying a spectacular Maltese sunset at sea.
